In these terms and conditions (the “Terms and Conditions”):

“The site”, “we”, “us” and/or “our”, “ours” refers to visa-vietnam.org.vn.

“User”, “Customer”, “you” and/or “your” refers to any individual or corporation who uses our website.

“Feedback” refers to any material you post on or through this Site that is specifically about how we can improve this Site and/or the products and services we make available through this Site.

Date format is dd/mm/yyyy. For example, 01/02/2016 means 01^st February 2016.

Time zone is Vietnam Standard Time (GMT +7).

Business/Working days includes the days between Monday and Friday excluding Vietnamese public holidays.

Business/Working hours is from 8 AM to 5 PM every Monday to Friday excluding Vietnamese public holidays.

Single entry visa allows an uninterrupted stay. Once a foreigner leaves Vietnam, he/she cannot enter again without obtaining a new visa. This kind of visa is the so-called “visa with single use”. For example, if you apply for 1-month-single-entry-visa, you are allowed to enter and exit Vietnam one time only within 30 days since your pre-registered arrival date.

Multiple entries visa allows multiple stays in one or more countries, as long as the total length of the stay does not exceed the validity period of the visa from the date of first entry. For example, if you apply for 3-month-multiple-entry-visa, you are allowed to enter and exit Vietnam multiple times within 90 days since your registered arrival date. In case, you travel to Vietnam using visa on arrival service, your first entry must be by air. Later entries can be either by land or by air since at that time Vietnam visa stamp is already on your passport.

1. AGREEMENT TO TERMS AND CONDITIONS

1.1. This terms and conditions are valid as the Agreement (Contract) between you and visa-vietnam.org.vn. Before choosing “Agree” button, you have responsibility to read and check the Agreement below carefully in order to understanding and acceptance the policies made available to you within the services.

1.2. By access the site, using the service, sending or delivering your passport(s), application(s), other document(s) to visa-vietnam.org.vn, you acknowledge READING and ACCEPTING these terms and conditions and that you agree to comply with them and NOT to violate our policies.

1.3. If you object or are dissatisfied with any of the terms and conditions set out in this agreement, you should not accept these Terms and Conditions or register for access or use the Services.

1.4. Please notice that visa-vietnam.org.vn is neither an embassy nor Vietnam government website. However, the site is operated by Greentek Global Company Limited cooperating with Vietnam Immigration Department to offer visa on arrival service for international customers to entry Vietnam.

2. MODIFICATION

2.1. Visa-vietnam.org.vn is permitted from time to time to modify, delete or add any new terms to the Terms and Conditions without any notification. These changes will be effective immediately as of the date we post the revised version on our site. Your continued use of the services will be deemed acceptance thereof. Hence, you are advised to review the current Terms and Conditions prior to initiating a transaction.

2.2. Please note that any of the content on the website may be out of date at any given time, and we are under no obligation to update it.

3. YOUR USE OF THE SITE

3.1. You may only use our Website for lawful purposes. You may not use our website:

• (a) in any way that breaches any applicable local, national or international law or regulation;
• (b) in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
• (c) to send, knowingly receive, upload, download, use or re-use any material which does not comply with the Terms and Conditions;
• (d) to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam); or
• (e) to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information or adversely affect the operation of any computer software or hardware

3.2. You agree:

• (a) not to reproduce, duplicate, copy or re-sell any part of our Website save where expressly permitted to do so by these Terms and Conditions;
• (b) not to access without authority, interfere with, damage or disrupt:
• (i) any part of our Website;
• (ii) any equipment or network on which our Website is stored;
• (iii) any software used in the provision of our Website; or
• (iv) any equipment or network or software owned or used by any third party.

3.3. We may from time to time provide interactive services on our website which shall enable you to upload or post contributions to the website, including, without limitation comment facilities and chat tools. Your contributions must not:

• (a) contain any material which is trade libelous or defamatory of any person;
• (b) contain any material which is obscene, pornographic, offensive, hateful or inflammatory;
• (c) promote violence or promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
• (d) be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
• (e) be likely to harass, upset, embarrass, alarm or annoy any other person;
• (f) be likely to deceive any person;
• (g) infringe any intellectual property rights, other proprietary rights or the privacy or confidential information of any person;
• (h) be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
• (i) advertise any goods or service or be for a commercial purpose
• (j) give the impression that they emanate from us, if this is not the case; or
• (k) advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

3.4. You may not create an account and use our Services if You are under the minimum age in your Home Country who is not of legal age to form a binding contract with visa-vietnam.org.vn or who is barred from receiving the Services under the laws of any country including from your country or which country You are using the Services.

4. LIMITATION OF LIABILITY

4.1. In no event will visa-vietnam.org.vn, service providers, or consultants, or their respective directors, employees, and agents be liable for any direct, special, indirect, or consequential damages, or any other damages of any kind, including but not limited to loss of use, loss of profits, or loss of data, whether in an action in contract, tort (including but not limited to negligence), or otherwise, arising out of or in any way connected with the use of the sites, the services, the content or the materials contained in or accessed through the sites, including without limitation any damages caused by or resulting from your reliance on any information obtained from visa-vietnam.org.vn, or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of god, communications failure, theft, destruction, or unauthorized access to our site’s records, programs, or services.

4.2. In no event shall the aggregate liability of visa-vietnam.org.vn, whether in contract, warranty, tort (including negligence, whether active, passive, or imputed), product liability, strict liability, or other theory, arising out of or relating to the use of any site exceed any compensation you pay, if any, to visa-vietnam.org.vn for access to or use of the applicable site.

5. ACCOUNTS, PASSWORDS, AND SECURITY

5.1. To use the site, you are required to open a user account and to provide a user identification name and password. When you choose, or you are provided with, a user identification name or password to access certain parts of our website, you must treat such information as confidential. Your identification name and/or password are non-transferable.

5.2. You are responsible for the activity that happens on or through your visa-vietnam.org.vn account. We have the right to disable any user identification name, code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms and Conditions.

5.3. Try not to reuse your visa-vietnam.org.vn account password on third-party applications. We are not responsible for any losses arising from the unauthorized use of your account. If you suspect that your account has been compromised, you must immediately notify us at visa@visa-vietnam.org.vn. You are liable for any unauthorized use of your user name, code and/or password.

6. LINKS TO OTHER SITES

6.1. Where the visa-vietnam.org.vn contains links to other sites or resources, these links are provided for your information only. Such links should not be interpreted as an endorsement by us of those linked websites or resources. When selecting a link to an outside website, you are leaving the visa-vietnam.org.vn site and are subject to the privacy limitations and policies of the owners/sponsors of that sites or resources. We have no control over or guarantee about the accuracy, relevance, timeliness, or completeness of information contained on a linked sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. You should check the terms of use applicable to any website or other resources that you link to from the Website.

6.2. You may link to the homepage of visa-vietnam.org.vn, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. The visa-vietnam.org.vn site must not be framed on any other site, nor may you create a link to any part of the site other than the homepage. We reserve the right to withdraw linking permission without notice.

7. PRIVACY POLICY

7.1. When this privacy policy applies?

7.1.1. This policy applies to personal information collected on visa-vietnam.org.vn owned or controlled by Greentek Global Company limited.

7.1.2. The aim of this policy is to tell you how we will use any personal information we collect or you provide through our websites. Please read it carefully before you proceed. The data controller in respect of this website is Greentek Global Company Limited.

7.2. What personal information do we collect?

7.2.1. If you wish to use our service, we may collect the following personal information from you which required to complete a visa application with Vietnam Immigration department to issue the visa Approval Letter:

• (a) Full name, passport number, date of birth, nationality, passport expiry date
• (b) Date of arrival Vietnam

For citizens of difficult nationality specified in Special Nation list of Vietnam Immigration Department, you are advised to send us more documents:

• (a) Scan copy of Passport
• (b) Returned flight tickets
• (c) Hotel booking
• (d) Invitation letter (if you have)

7.2.2. We will also keep a record of any financial transaction you make with us but we do not directly collect, process or store your debit or credit card information. Online payments made through this website are processed securely by a third party payment provider Paypal and Onepay. Please refer to Paypal and Onepay's Privacy for how your payment card data is processed by them.

7.2.3. You may also choose to provide additional voluntary information in the course of your use of this website.

7.3. How will your personal information be used and shared?

7.3.1. The personal information we collect allows us to:

• (a) provide the services you have ordered;
• (b) verify your identity and details of your payment method or credit card amount;
• (c) administer our website and provide customer services;
• (d) meet legal, regulatory and compliance requirements;
• (e) monitor and analyze the use of any account to prevent, investigate and/or report fraud, terrorism, misrepresentation, security incidents or crime;
• (f) gather management information to form statistical and trend analysis;
• (g) communicate with you;
• (h) investigate any complaints about this website;
• (i) personalize your experience of this website; and
• (j) contact you about our products and services which we think might be of interest to you (where we have the appropriate permissions to do so).

7.3.2. We may share your personal information with all of our affiliate companies for the above purposes.

7.3.3. We may not share your personal information with any companies for commercial purpose.

7.3.4. We shall submit all personal information excluding your payment information to Vietnam Immigration Department for verifying your visa. At the arrival airport, Vietnam Immigration Department may show the information publicly in the list of at least twenty people. If you wish your information not being showed publicly, you are advised to use our service of providing a confidential letter (which is currently US$10).

7.4. Information security and protection of personal information

7.4.1. Visa-vietnam.org.vn is well aware of the importance of protecting personal information and other information with which it has been entrusted by its customers; has created a system for the management of information security; and endeavors to manage information appropriately on a group-wide basis through the establishment and enforcement of global rules and regulations.

7.4.2. We take all reasonable steps to protect your personal information, including internal and external security, restricting access to personal information, maintaining technology products to prevent unauthorized computer access and regularly reviewing our technology to maintain security.

8. PROCESSING TIME

8.1. We guarantee delivery of visa Approval Letter in 2 working days by email for normal case; a for business visa, the processing time may take 3 working days. In case that you wish to get the visa Approval Letter sooner than 2 working days, there are 03 packages for your option as details:

• (a) Urgent case (guaranteed from 4 to 8 working hours): This package is effective for whom needs visa in emergency. We shall send the Approval Letter via email in 4 to 8 working hours. If you apply on Saturday, Sunday or Vietnam public holiday, it shall be processed in the next business day. The extra charge is from US$19/person. You are subject to pay stamping fee at the airport. If you wish not to pay stamping fee at the airport, please contact us to apply for full package.
• (b) Emergency case (within 30 minutes): Similar to the Urgent option but it only takes 30 minutes. The extra charge is from US$49/person. You are advised to call our hotline +84.909.579.252 to confirm the application has been received and acknowledged to process immediately. You are subject to pay stamping fee at the airport. If you wish not to pay stamping fee at the airport, please contact us to apply for full package.
• (c) Holiday case (for Saturday, Sunday or Vietnam public holiday): You are required to choose this package if you are applying for a Vietnam visa and flying out on a same day being weekend or Vietnam public holiday. The extra charge is from US$190/person. You are advised to call our hotline +84.909.579.252 to confirm the application has been received and acknowledged to process immediately. This fee, however, includes the stamping fee since we shall arrange a staff obtaining the visa for you at the airport before your arrival.

9. AMENDMENT

9.1. The visa Approval Letter can NOT be changed or amended once it is issued. Therefore, please double – check all information to make sure it is correct. All correction must be notified at least 3 working days to your arrival date for normal case. Otherwise, you are required to re-apply for a new letter of approval to make any changes.

10. CANCELLATION

10.1. No cancellation shall be made in case you decline to get a visa Approval Letter containing incorrect details caused by mistakes from your side.

10.2. No refundable in the following cancellation cases:

• (a) Your visa application is under processing after completing payment.
• (b) The visa Approval Letter is sent to your email.
• (c) For Extra Services (such as Fast Track and Car pick-up, VIP service), if we have already arranged these services for the customers.
• (d) The customers have any changes about their flight details and arrival day but we are not notified in advance.

10.3. You can only get the refund from the cancellation if your application has not been processed yet and you are required to inform us via email within 1 hour after payment for Normal case, 30 minutes for Urgent, Emergency, and Holiday case.

11. REFUND

11.1. No refund will be made in case you decline to get a visa approval letter containing incorrect details caused by mistakes from your side.

11.2. You shall be refunded 100% in cases that:

• (a) Denied applications by Vietnam Immigration Department
• (b) With our errors, we will refund 100% fee or arrange the new one correctly without any service fee.

11.3. No charges or penalties shall be made in case you wish to cancel service before making any payment.

12. DISCLAIMER

12.1. In no event shall we be responsible for any damages or losses whatsoever, direct or indirect, incidental or consequential, special or punitive, arising from or relating to the unauthorized use, change, deletion or exposure of any information, confidential or not, resulting from unauthorized breaking into the system or any other breach of security, or system failure.

13. FEEDBACK AND INFORMATION

13.1. Although we do not claim ownership of user contributions that you post using this Site, the Feedback you provide to us through this Site will be and remain our exclusive property. Your submission of Feedback will constitute an assignment to us of all worldwide rights, title, and interests in your Feedback, including all copyrights and other intellectual property rights in your Feedback. We will be entitled to reduce to practice, exploit, make, use, copy, disclose, display or perform publicly, distribute, improve and modify any Feedback you submit for any purpose whatsoever, without restriction and without compensating you in any way. For this reason, we ask that you not send us any Feedback that you do not wish to assign to us.
